Terms of service

1. About this agreement

bmopass is part of Epione Trading Ltd, company number 17173162. These terms are for businesses buying bmopass services, including sole traders acting for business purposes. They are not the terms of the rewards, goods or services offered by those businesses to their customers.

A subscription is formed when your order is accepted and its plan, billing period and agreed setup requirements are confirmed. The accepted order and any signed service or data-processing agreement form part of your contract. A specifically agreed written term takes precedence over a conflicting general term.

Contact us at sales@bmopass.com. These terms do not remove rights that cannot lawfully be excluded.

2. What your plan includes

bmopass provides supported digital wallet cards, a staff portal and the features described for your chosen plan in the accepted order. Customer-facing cards use your business branding. Every plan includes a free digital business card and unlimited customers and staff. Pro, Scale and Enterprise include custom branding of the staff app and portal.

Essentials, Pro and Scale cover one business at one location. Essentials includes one stamp or points scheme. Pro and Scale allow additional supported card types and several schemes. Scale includes a monthly campaign prepared for approval, four seasonal card artwork updates a year and a monthly results review. Enterprise and Clinic are coming soon and are not currently available to purchase. Enterprise is intended for multi-site businesses under the same owner, with rollout and migration requirements agreed in the order. This does not grant a right to resell subscriptions to unrelated owners.

Dedicated appointment cards are a separate Clinic product, not part of the salon plans. The practice’s booking workflow and setup must be confirmed before activation. SMS and nearby Wallet reminders are not generally available in the current launch offer. Any later messaging or integration service requires confirmed availability, permissions, an agreed allowance and disclosure of charges before activation.

The staff app can be added to the home screen on compatible devices. It is a web app, not a promise of a separately published App Store application. Wallet availability and updates depend on the card type, device and provider.

3. Prices and subscription billing

For new standard subscriptions, Essentials is £17 per month or £170 annually; Pro is £39 per month or £390 annually; Scale is £69 per month or £690 annually. Monthly subscriptions renew each calendar month. Annual subscriptions are paid upfront for twelve months at the price of ten monthly payments: two months free. There is no standard setup fee. No VAT is added to these subscription prices. Existing founding rates and agreed billing schedules remain unchanged unless separately agreed.

The GBP price is the base subscription price. Other currency displays are estimates. The final amount, currency, billing period and any applicable additional charges must be shown before you authorise payment. Stripe handles payment processing when checkout is enabled.

Subscriptions renew for the same billing period unless cancelled before renewal. A change of plan, billing period or price requires the applicable charge and effective date to be disclosed. We will give at least 30 days’ notice of a subscription price increase, which will not change the price of an already-paid period.

If a payment fails, we will contact you to resolve it. We may suspend service if payment remains overdue after notice and a reasonable opportunity to put it right. Suspension can stop new card issuance and updates.

4. Cancellation and refunds

You can request cancellation by emailing sales@bmopass.com from your account email, identifying your business. Cancel before the next renewal to stop the next subscription charge. Cancellation normally takes effect at the end of the period already paid for.

Every plan includes a 30-day money-back guarantee. Cancel and request a refund within 30 days of your first paid subscription charge. We refund subscription charges paid during that initial 30-day period and stop further subscription charges. This applies to monthly and annual billing, including discounted sales offers. A free trial or £0 invoice does not start the period. Renewals and plan changes do not restart it. To request a refund, email us from your account email and identify your business and subscription.

After the first 30 days, subscription fees are not refundable for part of a billing period, except where these terms or applicable law provide otherwise. Standard subscriptions have no minimum term beyond the period paid for. Any separately accepted discounted contract retains its stated term; the 30-day guarantee still applies. This does not prevent a refund required by law or agreed because we have failed to provide the contracted service. If we end the service for our own convenience, we will refund the unused prepaid period. No revenue or results guarantee applies unless its exact conditions are separately agreed in writing.

5. Your business and your customers

You are responsible for accurate business details, staff permissions, content, rewards, offers and customer records. You must have the rights to use uploaded branding and the appropriate basis for processing customer information or sending messages.

Your business supplies and honours the rewards, appointments, memberships, prepaid sessions and gift-card balances it offers. bmopass supplies the recording and communication tools; it does not fund those promises. bmopass subscription checkout does not automatically provide payment collection from your own customers.

Do not use the service unlawfully, send unsolicited marketing, access another business’s records, compromise security or submit information you are not authorised to use. Remove access for staff who no longer need it.

6. Data and confidentiality

Our privacy and data policy explains bmopass’s handling of enquiries and business-account data. For customer data processed on your behalf, your business is normally the controller and bmopass the processor. A service-specific data-processing agreement must cover instructions, confidentiality, security, suppliers, transfers, assistance with rights and end-of-service handling.

Appointment information may reveal health information. Appropriate processing terms and a lawful basis must be established for the proposed setup before that information is transferred. Recall Pass is an appointment communication tool, not a clinical record, emergency service or guarantee that every reminder will be received.

Request any needed export before your subscription ends. Retention, deletion and backup handling follow the applicable data-processing agreement and legal requirements. A saved wallet card may remain on a device after service ends while new issuance and updates stop. Your obligations to customers do not disappear when you cancel bmopass.

7. Availability, ownership and liability

We will provide the service with reasonable care and skill. Connectivity, maintenance and third-party services may affect availability or message delivery. We do not promise uninterrupted operation, zero latency or a particular increase in revenue, visits or satisfaction. Published market research is not a statement of bmopass customer results.

You retain rights to your branding and content. We retain rights to the bmopass software and grant permission to use it for your subscribed business purposes. Publicity using your identity or non-public results requires separate agreement.

To the extent permitted by law, neither party is liable for indirect or consequential losses. bmopass’s aggregate liability arising from the service in a twelve-month period is limited to the subscription fees paid or payable for that period, subject to separately agreed terms. Nothing limits liability for fraud, death or personal injury caused by negligence, or liability that cannot lawfully be limited.

8. Changes and disputes

We will provide at least 30 days’ notice of material contractual changes, with the opportunity to cancel before they take effect. Changes required by law or urgently needed to address misuse or security may take effect sooner, with an explanation.

Please contact us first so we can try to resolve a service or billing issue. These business terms are governed by the laws of England and Wales, whose courts have jurisdiction, without overriding mandatory rights or jurisdiction that apply by law.
